Terms and Conditions

The rules for using Local Sounds Radio. Please read these carefully.

These Terms and Conditions ("Terms") govern your use of the Local Sounds Radio platform, including the website at localsounds.com.au, our mobile applications, and all related services (collectively, the "Platform"). The Platform is operated by Local Sounds ("we", "us", or "our"), an Australian digital radio and music discovery service.

By creating an account, signing in, submitting music, or otherwise using the Platform, you ("you" or "User") agree to be bound by these Terms. If you do not agree, please do not use the Platform.

These Terms work alongside our Privacy Policy. Some services have their own additional terms — see our Advertising Terms and Conditions for advertising bookings, and our Local Sounds Tips for tipping artists.

1. Eligibility and Accounts

  • You must be at least 16 years old to create an account. If you are under 18, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.
  • You may create an account using an email address (we'll send you a sign-in link), by signing in with your Google account, or — for administrators — using a username, password, and two-factor authentication.
  • You are responsible for keeping your sign-in credentials secure and for all activity under your account.
  • You must provide accurate information when registering and keep it up to date. Impersonating another person or misrepresenting your affiliation with any artist, band, or organisation is prohibited.
  • We may suspend or close any account at our discretion or if it breaches these Terms, contains false information, or is used for unlawful or harmful purposes.

2. Acceptable Use

When using the Platform, you agree not to:

  • Upload, post, or transmit any content that is unlawful, defamatory, obscene, hateful, harassing, or that infringes the rights of others.
  • Submit music, artwork, or other content that you do not own or do not have the necessary rights to use.
  • Attempt to gain unauthorised access to the Platform, other user accounts, or our systems.
  • Use automated tools (bots, scrapers, crawlers) to access, copy, or harvest content from the Platform, except for publicly available data accessed through documented means.
  • Interfere with or disrupt the Platform's operation, security, or the experience of other users.
  • Use the Platform to distribute spam, malware, or fraudulent content.
  • Misuse the Local Sounds Tips, advertising features, or any payment functions for purposes other than their intended use.

3. Your Music and Content

We respect your rights. You own 100% of your music, artwork, and promotional materials ("Artist Content"). Because Local Sounds is fully licensed by APRA AMCOS and PPCA, your broadcast rights and royalties remain fully protected under standard industry frameworks.

When you submit content to us, we just need the standard practical permissions to help promote you. You confirm that:

  • Ownership: You own or have the explicit right to share the music, artwork, and info you submit.
  • Clearances: Any co-writers, producers, or featured artists have agreed to let you submit this material.

How We Use Your Content: By submitting your material, you give Local Sounds permission to stream, broadcast, play, and host your music and artwork across our radio programming, website, and app.

To help us shout about your music, you also give us permission to use your artwork, images, and Radio IDs in our social media posts, newsletters, and promotional materials. While you can ask us to stop using your content at any time by closing your account (subject to a reasonable wrap-up period for pre-scheduled shows or cached data), the use, placement, and featured display of artwork, Radio IDs, and promotional assets on our channels remains at the sole discretion of Local Sounds.

Airplay Discretion: Submitting your music is the first step, but it does not guarantee airplay or a permanent feature. Local Sounds reserves the complete right to curate our station programming. We may accept, reject, schedule, or remove any submission at our discretion to maintain the quality and flow of our broadcasts.

4. Intellectual Property

You retain ownership of your Artist Content. Local Sounds and its licensors retain all rights, title, and interest in the Platform itself — including the Local Sounds name and logo, the website design, software, databases, and all original content created by us (such as editorial articles, charts, and AI-generated insights).

You may not copy, modify, distribute, sell, or create derivative works from any part of the Platform (other than your own Artist Content) without our prior written permission.

5. Paid Services

Some features — such as Amplified campaigns, advertising packages, and premium artist tools — are paid services. Payments are processed securely by Stripe. Specific terms for advertising bookings are set out in our Advertising Terms and Conditions, and Local Sounds Tips payments are governed by our Local Sounds Tips Terms.

Unless otherwise stated, all fees are quoted in Australian Dollars (AUD) and exclude GST where applicable.

6. Third-Party Services

The Platform integrates with third-party services including Google (sign-in), Spotify (artist data), Stripe (payments), SendGrid (email delivery), OpenAI (AI features), and various streaming and social platforms. Your use of those services is subject to their own terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

7. Suspension and Termination

You may close your account at any time by contacting us at contact@localsounds.com.au.

We may suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms, infringed third-party rights, or used the Platform in a way that may harm us, other users, or the public. On termination, your right to use the Platform ends immediately, but provisions which by their nature should survive termination (including ownership, indemnities, disclaimers and limitations of liability) will continue to apply.

8. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations about the Platform's accuracy, reliability, completeness, availability, or fitness for any particular purpose.

Nothing in these Terms is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded, restricted or modified.

9. Limitation of Liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. To the maximum extent permitted by law, Local Sounds will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with your use of the Platform.

Where our liability cannot be excluded but can be limited, our total aggregate liability to you in connection with the Platform is limited to (at our option) the resupply of the relevant service, or AUD $100.

10. Indemnity

You agree to indemnify and hold Local Sounds, its directors, employees, contractors, volunteers and partner stations harmless from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from your breach of these Terms, your Artist Content, or your misuse of the Platform.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date above and, where the changes are significant, notify you by email or through the Platform. Your continued use of the Platform after changes take effect means you accept the updated Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Queensland, Australia. You and Local Sounds submit to the non-exclusive jurisdiction of the courts of Queensland and the courts competent to hear appeals from those courts.
